General terms and conditions of Caimco
Article 1 - Definitions- General terms and conditions applicable between Caimco and the customer
- Caimco , having its registered office at Asten, registered in the Commercial Register of the Chamber of Commerce under no: 88770621 and VAT number: NL864772361B01.
- Customer: a (legal) person who purchases a Product through the website.
- Purchase Agreement: the contract of sale concluded between Caimco and the Customer upon the purchase of a Product.
- Supplier: the party with whom Caimco has concluded an agreement.
- Product(s): all products offered on the website by Caimco.
- The name Caimco is associated with GC Online Trading.
Article 2 - Applicability
- These General Terms and Conditions apply to the order of a Product and the Purchase Agreement.
- Each customer placing an order for a Product accepts the applicability of these General Conditions.
- These General Terms and Conditions and the rules and regulations applicable hereunder may be amended unilaterally by Caimco. Amendments will only take effect after the amendments have been announced on the Website. If a Customer places an order for a Product after the announcement described in the previous sentence, the Customer thereby accepts the applicability of the amended General Terms and Conditions.
Article 3 - Customer Account
- The Customer is at all times responsible for the confidentiality and use of his login details (such as user name and password) and for the accuracy of his data in his own account.
- The Customer declares to act in accordance with these General Terms and Conditions and all applicable laws and regulations.
- The customer must be reachable by e-mail and if requested by Caimco also by telephone.
Article 4 - Offer
If an offer has a limited period of validity or is made subject to conditions, this will be explicitly stated in the offer.
- The offer is without obligation. Caimco is entitled to change and amend the offer.
- The offer contains a complete and accurate description of the products and/or services offered. The description is sufficiently detailed to enable a proper assessment of the offer by the Customer. If Caimco uses images, these are a true representation of the products and/or services offered. Obvious mistakes or obvious errors in the offer do not bind Caimco.
- All images, specifications and information contained in the offer are indicative and may not give rise to compensation or to dissolution of the agreement. Caimco cannot guarantee that the displayed colors exactly match the actual colors of the products.
- Any costs of shipment, method of payment, delivery and performance of the agreement.
- The offer of Caimco concerns custom parts. The fit may deviate from the original. The customer is responsible for the fit or not of the parts on his or her scooter. Obvious mistakes or errors in the offer do not bind Caimco.
Article 5 - Purchase Agreement
- After acceptance of the order, a purchase agreement will be concluded between the customer and Caimco .
- If an offer has a limited period of validity or is made subject to conditions, this will be expressly stated in the offer.
- Each agreement is entered into under the suspensive conditions of sufficient availability of the relevant products.
Article 6 - Right of withdrawal.
- When purchasing products, the Customer has the possibility of dissolving the agreement without giving reasons for a period of 14 days. This cooling-off period commences on the day after receipt of the product by the Customer.
- During the reflection period, the Customer shall handle the product and its packaging with care. If the Customer exercises his right of withdrawal, the Customer will return the Product with all delivered accessories, if possible in its original state to Caimco, in accordance with the instructions provided by Caimco.
- The Customer must return the return shipment to Caimco within 7 days after he has notified Caimco that he wishes to exercise his right of withdrawal.
The Customer must prove this by means of proof of dispatch.
- If the Customer has not expressed his wish to exercise his right of withdrawal or has not returned the Product to Caimco after the expiry of the periods referred to in paragraphs 2 and 3, the purchase is a fact.
Article 7 - Costs in case of withdrawal.
- If the customer exercises the right of withdrawal, the costs of returning the goods will be borne by the customer.
- If the customer has paid an amount, Caimco will refund this amount as soon as possible, but at the latest within 14 days after revocation.
- In the event of damage to the Product due to careless handling by the Customer, the Customer shall be liable for any depreciation in value of the Product.
Article 8 - Order and delivery.
- When placing an order for a product, the Customer undertakes to read and accept these General Terms and Conditions of Caimco.
- Subject to what is stated in paragraph 3 of this article, Caimco will execute accepted orders expeditiously, but at the latest within 30 days , unless the Customer has agreed to a longer delivery period.
- All delivery periods are indicative. The Customer cannot derive any rights from any terms mentioned. Exceeding a term does not entitle the Customer to compensation.
- The risk of damage and/or loss of products rests with Caimco until the moment of delivery to the Customer.
Article 8 - Payment.
- Unless otherwise agreed, the amounts due by the Customer must be paid immediately via Ideal, unless Caimco has agreed another payment arrangement with the Customer.
- The Client has the duty to report inaccuracies in payment information provided or stated immediately to Caimco.
- In case of non-payment by the Customer, Caimco has the right, subject to legal restrictions, to charge the costs previously made known to the Customer.
Article 9 - Complaint Procedure.
- Complaints about the performance of the agreement must be submitted to Caimco fully and clearly described within 1 month after the customer has discovered the defects.
- Complaints submitted to Caimco will be answered within a period of 14 days from the date of receipt. If a complaint requires a foreseeable longer processing time, the Customer will be replied within the 14-day period with a notice of receipt and an indication of when the Customer can expect a more detailed reply.
- For complaints, the Customer should first turn to Caimco .
- If the complaint cannot be resolved by mutual agreement a dispute arises which is subject to the dispute resolution procedure.
- A complaint does not suspend Caimco's obligations, unless Caimco states otherwise in writing.
- If a complaint is upheld by Caimco , Caimco will at its option either replace or repair the delivered products free of charge.
Article 10 - Applicable law.
- Agreements between Caimco and the Customer governed by these General Conditions are governed exclusively by Dutch law. Even if the customer resides abroad.
